Big update on H-1B visas: The White House published a Proclamation requiring a $100k fee for new H-1B applications, and chaos immediately followed, especially for students and workers planning travel or new applications.
Here’s the good news, both the Press Secretary and USCIS confirmed the rule:
• Only a one-time $100k fee for new visas
• No impact on current H-1B holders or renewals
• Will take effect for the 2026 H-1B lottery, not current visa holders

New $100,000 fee on H-1B entries by presidential proclamation
Big news: On September 19, 2025, President Trump issued a presidential proclamation requiring a $100,000 fee for certain H-1B petitions filed from outside the U.S. Effective September 21, 2025, U.S. entry will be restricted unless this fee is paid. The fee does not apply to petitions already filed, approved petitions, or H-1B holders inside the U.S., but international travel is strongly discouraged. DHS may exempt individuals or employers in the “national interest,” though standards are unclear. USCIS guidance clarifies the fee is prospective only, but key questions about extensions, transfers, and cap-subject petitions remain unanswered.
DHS proposes wage-weighted H-1B lottery
On September 25, 2025, DHS will publish a proposed rule to end the random H-1B lottery and move to a wage-based system. Level IV wage positions will receive 4 entries, Level III 3 entries, Level II 2 entries, and Level I 1 entry. The rule favors higher-paid workers and reduces chances for entry-level roles. Legal challenges are expected over compliance with the Immigration and Nationality Act.
USCIS announces 2025 naturalization civics test
On September 18, 2025, USCIS published notice of a revised civics test for naturalization applicants. The new test replaces the 2008 version for applications filed on or after October 20, 2025. Applicants will be asked up to 20 questions from the 128-question bank introduced in 2020 and must answer 12 correctly to pass. The English language portion remains unchanged. Older applicants (65+ with 20 years as permanent residents) will continue to take a shorter 10-question test.
